I've been told again and again by less than totally authoritative sources that I MUST have a "Publisher's Statement" (name of publisher, address, etc)in each issue of a humor bi-weekly we are creating. This is a free distribution magazine with no subscription or mailings. I cannot find any state (FL) or federal law specifically addressing this area. Any insights or directions would be welcome -- I believe such statements (while good form generally) are only required by the postmaster. Thanks

http://www.usps.com/cpim/ftp/hand/dm204/appa.html has publisher statement requirement for obtaining periodical mailing rates...but I can't find any other legal requirements. (Well, Florida has a state law holding the publisher liable for defamation if disclosure of the writer of a defamatory article is not disclosed, but aside from that I haven't found anything relevant.)

As far as I know, and I am not a lawyer, you only need the publisher's statement to get a 2nd class or otherwise special postal rate. Few of the small presses I know have bothered with either.
