Before I begin anything, do I need to obtain a patent for the name of my magazine and if so how do I go about obtaining one. Also, is it a good idea to begin the magazine as a newsletter and then work my way up to a full fledged mag?

You can't patent the title of a magazine. You could get a trademark on the title as a logo, but that would be very expensive. The best thing to do is get your newsletter started and apply for an ISSN (see other messages on this subject). That doesn't stop anyone else from using your title, but yours will be the only publication recognized officially by that name. As to starting as a newsletter or magazine, I'd start as a newsletter to get a feel for what your readers want and then expand later.
